Mark Shmueli wins Motion to Reopen for a Young Military Spouse who was Ordered Removed in 2005

The Law Offices of Mark Shmueli, along with DHS counsel, filed a Joint Motion to Reopen the proceedings before the BIA, in order to seek termination of the proceedings and vacate the client’s removal order. With substantial help from the USCIS Ombudsman’s office, in part to clarify whether jurisdiction to adjudicate parole-in-place applications for those in removal proceedings lies with CIS or ICE, CIS has now granted our client Parole-in-Place!  While we hope our client’s spouse is not deployed in the near future (he has already had multiple tours in the Middle East), this grant of parole-in-place prevents ICE from deporting his wife–the mother of their infant child–while he is putting his life on the line for the only country that this couple has ever called home.
